Incentives Compliance Team

The Incentives Compliance Team monitors and reports on development projects qualifying for Executive Order 2024-2, Tax Abatement Post Construction job commitments, and Community Benefits Ordinance agreements and complaints. The Incentives Compliance Team works closely with developers, contractors and city departments to ensure compliance with all agreements.

 

Executive Order 2024-2 
Executive Order 2024-2 applies to any publicly funded construction project contract for more than $3,000,000 made by the City with any person or entity or any Construction Project the City provides funds or financial assistance over $3,000,000. Executive Order 2024-2 requires that 51% of the hours on the publicly funded construction project shall be worked by bona-fide Detroit residents. If the projects falls below 51% workforce target, workforce contributions are calculated accordingly and charged to the project's general contractor. The workforce contribution funds go towards the city's workforce training fund.

Form used to verify the Detroit residency of workers on construction projects qualifying for EO 2024-02 monitoring. It is to be filled out monthly by contractors on these projects.

Community Benefits Ordinance 
The Community Benefits Ordinance (CBO) is a law that requires developers to proactively engage with the community to identify community benefits and address potential negative impacts of certain development projects. The ordinance was approved by Detroit voters in 2016 and amended by City Council in 2021. The Community Benefits Ordinance applies when a development project: Is $75 million or more in value, receives $1 million or more in property tax abatements or receives $1 million or more in value of city land sale or transfer. The Incentives Compliance Team monitors each community benefits developments' commitments, reports on each developments' compliance, and investigates complaints from the community.

Submitted complaints are shared with the Neighborhood Advisory Council (NAC) and reviewed by City staff. Inquiries are made with relevant departments and response prepared.
